Hong Kong currently employs 390,000 migrant domestic workers (MDWs), 98% of them come from the Philippines and Indonesia.
MDWs are required to live at their employers’ residence (live-in rule), causing concern over the protection of the right to privacy under Article 17 of ICCPR.
MDWs have limited opportunity to change employers, violating Article 26 of ICCPR. MDWs have to leave Hong Kong in two weeks after their contracts end. (two-week rule) They are prohibited from changing employers when staying in Hong Kong to seek legal redress unless the Director of Immigration exercises his/her discretion.
Many MDWs are overcharged by employment agencies, leading to concern about forced labour.
